3. Our Response
Upon receiving a complete, valid DMCA notice, Syntha will:
- Promptly disable access to or remove the identified content.
- Notify the artist who submitted the content of the takedown, where legally permissible.
- Retain the notice and evidence for legal compliance purposes.
We reserve the right to reject notices that do not comply with the statutory requirements or that appear to be made in bad faith.
4. Counter-Notice
If you believe your content was removed as a result of mistake or misidentification, you may submit a written counter-notice to dmca@syntha.music. Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the content that was removed and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification.
- Your full name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any federal district court in the United States), and that you will accept service of process from the claimant or their agent.
Upon receiving a valid counter-notice, we will provide a copy to the original claimant and may restore the content within 10–14 business days, unless the claimant notifies us that they have filed a court action to restrain the activity.
5. Repeat Infringer Policy
In appropriate circumstances, Syntha will terminate the accounts of artists who are found to be repeat infringers. An artist account may be terminated after two or more verified DMCA (Digital Millennium Copyright Act) takedown notices for distinct works, at Syntha’s sole discretion. We maintain records of all DMCA notices received.
6. Good Faith and Abuse
Submitting a DMCA notice in bad faith — including filing notices for content you know you do not have rights to — exposes you to liability under 17 U.S.C. § 512(f). Syntha reserves the right to seek damages for abuse of the DMCA notice process.
